My current H1-B expires on 01/4/2011. I am planning to switch to EAD in November. What is the procedure to switch to EAD from H1-B. Is there any form that needs to be filled. Please advice. My company admin and HR have no idea and are asking me to find out for myself.

1) From the day your current one expires
2) Recent court ruling is that even if it is beyond 240 days from day your current one expires, your status is valid as you are waiting for decision. You can search for this, I read it couple of months back. Or seniors may confirm this.

If you really don't want to use the DataGrid, you could just use a ListBox. Each ListBoxItem (you can edit the ItemsTemplate) could be a textbox with a series of comboboxes inside it. That will give your users the illusion of having a scrolling list of items that they can enter values into.

My attorney has submitted the documents for I140/485 concurrent filing. UPS has messed up and they lost my documents.It contains original documents for applying I140.
I am wondering if there is any chance that I can send photocopy of documents to USCIS explaining them the situation as I do not want to miss the chance of deadline Aug 17th. Could anyone please suggest me? Did anyone experience the same situation before.

I don't know the answer....but I suggest community to NOT to use UPS...since I also lost my documents couple of times (while sending to attorney). I stopped using it

My PERM for EB3 has been approved on July 2008. My I-140 is pending. 485 has not been submitted yet. I don't have EAD card either. For some reason, I have to change job.
My question is, if my current employer will not revoke my current I-140 sponsorship, even I have left company, and in case my current I-140 will be approved, can my priority date be carried over?

Hi,
I am really confused about my current status.
I am currently on Opt Extension, which expires on June 1st 2010.
When i filed for H1b visa last year April 2009.
I got my petition approved, but my change of status was denied.
The reason was stated as :
The status previously accorded the worker had expired before this petition was filed. Therefore, the worker si not eligible for change of status.
Now, I am still in US. Is my status illegal?
Unless there is more to the story, you are currently in F1 status assuming that you are not violating OPT rules (e.g., you must be employed in your major field of study --- you cannot keep looking for job on OPT more than 3 months or so, IIRC). Your F1 status will cease when the OPT expires. You will go out of status from June 1, 2010 and so you should go out of US on or before that date. Then you need to get H1-B visa stamp from a consulate abroad (usually it has to be the consulate in your home country for the first stamping) and reenter US.
Make sure that you are not violating any OPT rules --- maybe USCIS thought that you are and that is why they denied COS?

Hi company A applied for my H1 in april 1st week.
they have got 2 rfe so far and now i am not interested in working with them(they also dont seem interested in replying to the 2nd rfe)
Another company is interested in filing my h1b.
what is the safest way to go about doing this.
should i let company B know that i filed with company A before.
Also will there be any problem in getting H1b approved because of my earlier filing
There should not be a problem in getting the H-1B approved by Co. B, assuming you and the position meet all the H-1B requirements. Just because there was a prior petition filed for you should not have a negative impact. You need to let Co. B know about the earlier filing, because there are some questions on the I-129 that might require them to provide information about the first filing.

3. You must send following documents.

I am posting this question on behalf of a friend who needs some guidance w.r.t. H4 extension.
His H1b expires at the end of this month and he had applied for an H1b extension during Nov '06 after he received his I-140 approval. He received a RFE this week with USCIS requesting for additional documents. He had not applied for H4 extension during Nov '06 as his wife just moved to US in Jan 07. Her H4 expires at the end of this month. His problem is if he can apply for H4 extension for his wife, even though his own H1b has still not been extended due to a RFE. He can continue working as his application is still pending with USCIS but can he apply for H4 extension for his wife along with the additional documentation he is now going to send to USCIS in response to the RFE? Or can he apply for H4 extension based on the H1b receipt notice from USCIS? Or does he have to wait until he receives his H1b extension approved before he can apply for H4 extension? If that is the case, what would his wife's status be after her H4 expires at the end of this month and he has still not received the approval notice for H1 extension. Anyone with some knowledge in this area, please advise.

I had posted some queries previously and thanks to all who took time to respond.
As I had said before , I have an admission to study for my MBA outside US for one year. Here is the latest update:
I was thinking I will get a one year leave abscence from my employer ( advt on the website), but apparently they dont support studies as part of the deal.
So i am out of luck;
Considering my situation what do you gurus recommend.
How can I leave US yet maintain my GC process.
My I-140 is approved
Situation:
Spouse in school Full time Studies on I-485 pending. ( entered on F1 then converted to I485..... so going back to F1 is impossible)..
I want her status to be preserved.
My thought:
Resign from my company when I need to leave. Convince them that I will return. Maintain no ties with the company for one year..basically can be compared to being jobless for one year.
and then get a letter that a future similar job will be available with the same Co. ( that sponsored my GC)...
Is this feasible ./practical?

I am currently on h1b, I am planning to join a new company and I qualify for EB2 category.
Is it possible to port priority date of my EB3 to EB2?? with my new employer?
