    Hi. I just e-filed my I-539, status of change request from F-1 to H-4. I just found out that I chose "North Korea" for my citizenship, while it was supposed to be "South Korea". I chose "South Korea" for the passport issuance country.

    How can I fix this? Should I attach a letter explaining this, when sending the supporting documents? What else supporting documents should I submit, other than my husband(H-1)'s paystub, I-129 approval notice and our marriage certificate?

    Use a good lawyer who can help with interpretation. USCIS has been flexible about the "same or similar" job thing , unless the jobs are entirely in a different occupation.

    I would suggest "use an Attorney to Draft this response"

    Hi
    I am applying for my change of status from h1b to Green card based on immediate relative who is spouce and a US citizen.

    On the form 485 , to mentions the non traffic citations do I need to mention the following citation that I received last year.
    1) Summary charge - Citation for Fishing without Fishing License in State of PA
    2) Summary Charge - Citation for False statement to the park officer about possesion of the Fishing License.

    Do I need to mention these citation when filing for form 485 ? (150$ fine)
    Is this going to affect the Immigration application? (200$ fine)

    Any idea how long does it take to get AP approved after a soft LUD on AP?

    I485/AP/EAD - NSC - Notice date 8/16/07.
    FP: Done 09/29
    EAD: Waiting
    AP: Waiting (Soft LUD 10/22)

    I had a LUD for AP on Oct 11th.No AP so far.
    There is no definite answer.

    Hi,
    I am on h1b status and my wife is on h4. She applied for an h1b(COS) this year (FY 2011) and the application has been approved. We received all the documents regarding H1b approval(except I-94). her employer said that we won't get an extended I-94 in this case.

    My concerns are,

    our visa's are getting expired on Sep 23(as per I-94 on visa its till 30Sep) and my company is planning to extend both H1B and H4. As she would be able to start work only from Oct 1 2010 and the visa is expiring on Sep 23, I think we have to extend her visa to avoid out-of-status. If I extend her h4 will it make her already approved H1b invalid?
    if its required to extend the H4 is it mandatory to start working on 1 Oct 2010? (she is pregnant now and due is on Nov 2010 , so cannot start on Oct-1)

    It is not clear if they are going to initiate a name check again. This could be associated with when your fingerprints get invalidated. If they initiate a fresh fingerprint (for what ever reason) without refreshing the existing one, that could trigger a name check. So that could be why they have a secondary check on preadjudicated cases.

    Yes he can travel during the transfer, in order to file the transfer he will have to show latest paystubs from his previous H-1 employer or he has to show that he reported to work and was hired before he can file for a transfer. To file a transfer the USCIS charges $500 +$320+ $750 ($1500 if the petitioner has more than 25 employees).

    Dear All:

    I know there are numerous people who are on H4 visa here in the USA and struggling to get out of home and work. All tied up in 4 walls only coz H4 visa holders do not have the authorization to work.
    Come on guys, when L2 dependant visa holders can get an EAD and permit to work then why cant H4 dependants get the same privilege ? Is this not a discrimination? Are we not being deprived of the rights that we should be getting? Are we doing justice to our careers? Aren�t 90% of H4 visa holders doctors, engineers, lawyers, MBA�s?? Are we not ruining our careers ? Are we not loosing our self esteem and independence ? are we not highly qualified and skilled to take up challenging jobs in the US ?
    We all know what it is with the H1B visa. In such a scenario how can we even expect some professional life for ourselves. But are the law makers aware of this situation of ours ? Laws are amended only when they are put forward and witnessed as a problem and issue of concern. Does the US government know about this ? Does US know that it has immense store house of talent in the form of H4 visa holders ?

    It has to change. H4�s should get some kinda reform else we will ruin our careers and life. If you are on the similar line then come forward and join us, in our change!!
    Let your voice be heard!! Let H4�s get their independence.

    Hi,
    I am a july 21 filer and received I-485 notices on Sept 26. I am required to join my job on Oct 8 and i want to use the EAD for that.

    My question is, if i see the status as "card ordered" before Oct 8, then can i call USCIS to get the EAD number before joining the job. OR does the employer need to be shown the EAD card before joining.



    It looks like it is taking 1 week from notice date to see the status change to "Card Ordered" and another 7-10 days or more to get the card.

    DONT EVEN TRY. wait for the EAD and in the mean time let your future employer know.They will not mind waiting for a week or so.

    Hi,

    I�m in EB2 and My I-140 was approved September 2008 through Employer A. And I got laid off on November 2009 from EMP A, within 15 days I joined another Employer B. As per policy, employer B is not going to file GC for me. Already I spend 5 years on my H1B. I check with EMP A�s HR dept, they will not revoke my I-140 and H1B. I know AC21 is one of the options to transfer (Portability) my PD to Emp B after apply I-485.

    It would be great if I get answer the below my Question:

    1. If my PD is current, Will I eligible to apply I-485 using Employer A I-140 approved?
    2. What are the documents needed from employer A, if I want apply I-485?
    3. All my friends telling me, I can apply I-485, Is it true?

    My status on I-140 changed to "Request for Additional Evidence". Notice was sent only on 25th, so I don't have any more details yet.

    U r absolutely right........ i have heard ppl saying they are willing to transfer H-1B's but they say they wont process GC............. This is just un believable.......... I guess the whole idea is to recycle ppl after every 6 years..........

    Last 3-4 years after India and Chinese economy started booming I have seen that many Indian companies (Infy/wipro/pcs) do not apply for Green Cards for all thier US employees. They file GCs for KEY employees and marketing guys.
    Most of the Software engineers work for 3,4,5 years and go back.
    I recently read somewhere that Infy/wipro although applied for 20K H1 visas only applied for less than 100 GC last year.

    Have you seen this trend?

    There are really 2 sub-categories of EB-3. One requires a minimum of a bachelor's degree, or equivalent in education/experience. The other requires just 2 years skilled worker experience.

    The question is what your position really is, and what the employer requires. If the position really requires you to speak Korean, it can get approved. However, adding a foreign language requirement definitely invites intense scrutiny, and it can really only work if you can show that you spend a lot of your time using Korean and the company could not manage without it. You also need to show that you use Korean with people who cannot speak English, not just that they don't want to speak English. You need extensive back-up documents to prove the foreign language requirement.

    Hi,

    I had my stamping done in Delhi last year in September. They just asked me the following:

    1. Latest Paystubs.
    2. W2.
    3. Client name.
    4. My responsibilities at work.
    5. How long have I worked at my employer.

    All this took just a couple of mins. One of my friend also got his stamping done in Delhi in Dec last year.

    Just carry all documents you can. They will not be needed, but you be more prepared and confident at the interview.

    Unless the dependent is going to have his 140 filed under EB1 I am not sure it would help.

    But to answer your question, I think it is ok to file. Check with your attorney before you do that though
